1. Overview

Pentagram Ltd ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated Copyright Agent.

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Service, please notify our Copyright Agent with a DMCA takedown notice containing the following information:

Required Elements of a DMCA Notice:

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL or specific video ID).
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Processing of DMCA Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material of the takedown
  • Provide the user with information about submitting a counter-notification
  • Maintain records of all notices and actions taken

We aim to process valid DMCA notices within 24-48 hours of receipt.

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification to our Copyright Agent containing:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or if outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the complainant

6. Counter-Notification Process

Upon receiving a valid counter-notification, we will:

  • Forward a copy of the counter-notification to the original complainant
  • Inform the complainant that the removed material will be restored in 10-14 business days unless we receive notice that they have filed a court action
  • Restore the removed material between 10-14 business days after receiving the counter-notification, unless we receive notice of a filed court action

7. Repeat Infringer Policy

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the Service and/or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

8. Misrepresentation Warning

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
